KRC has submitted comments critical of the EPA draft study on the potential impacts of hydraulic fracturing of coalbed methane wells on underground sources of drinking water. EPA has concluded that there is no need for further study of the potential for health effects from groundwater contamination due to fluid injection into coal seams. So-called hydraulic fracturing injects fluids under pressure into the coal seam to enhance fracturing and stimulate production of methane gas. KRC's comments argue that EPA has significantly understated the potential for harm to groundwater resources in the Appalachian coalfield region, and opposes any consideration of exempting hydraulic fracturing from regulation under the Underground Injection Control program. This is a speech Fitz gave Friday at the Kentucky Professional Engineers In Mining 15th Annual Seminar: I had always pondered whether the old Chinese proverb: "May you live in interesting times" was meant as a blessing or curse. Reflecting on the past year's event, I am still uncertain.
One thing that is certain, however, is that the job of the mining engineer has never been more critical to the successful design, permitting and implementation of a mine and reclamation plan than it has become in the past year and will be in the next few, as the industry reconfigures extraction and spoil management approaches to respond to regulatory and judicial decisions. Is there a Kentucky law that allows coal companies the right to condemn property for the purpose of hauling coal, either by road, conveyor, track or pipeline? This is a letter that was sent to Reid Paxton in response to request concerning the status of Kentucky law on allowing private mine operators to use condemnation powers for coal haul roads, conveyors and pipelines. Despite significant community opposition, Fiscal Court voted unanimously to weaken the erosion and sediment ordinance adopted in January, 2001. I am here today to express my concern with the weakening amendments to the Erosion Prevention and Sediment Control (EPSC) Ordinance that are proposed for First Reading today by Commissioner Maple. Five citizen organizations whose members include over 6,000 Kentucky residents are taking action to protect Kentucky's waterways. On May 19, 2001 the Kentucky Waterways Alliance, Kentuckians for the Commonwealth, the Sierra Club Cumberland Chapter, Floyd's Fork Environmental Association and Kentucky Resources Council, Inc. have served the required 60-day prior notice of their intent to sue the US Environmental Protection Agency (EPA) unless EPA acts within that time to publish a water quality standard protecting Kentucky's high quality streams and rivers. One of Kentucky's top environmental watchdogs has refused an invitation to speak to a national panel studying the safety of coal-waste impoundments. In an unanimous decision, the U.S. Supreme Court handed the smokestack industries a major defeat in their effort to stop implementation of new standards for limiting ozone pollution. The failed California experiment in restructuring the delivery of electricity at the retail level (called "deregulation" or "unbundling") may leave you wanting more information about what is occurring nationwide and what the impacts of deregulation might be for Kentucky's consumers. We have gathered today in the aftermath of the Martin County Coal Corporation coal slurry impoundment failure, to express our deep concern, to voice our bitter disappointment, and to outline those immediate actions that we believe represent the appropriate response to this latest in an unbroken line of tragedies, great and small, that have been imposed on a region of this state by today?s coal industry. At the request of local residents and at the invitation of the applicant Kentucky Mountain Power Company, the Council has been involved in the review of this project since its' inception, and has had a consulting firm review the draft permit for compliance with applicable regulations.
