NEWPORT STEEL REDUCTIONS CANNOT BE USED TO OFFSET VEHICLE PROGRAM LOSS  Posted: September 3, 2004
The EPA, in a letter dated August 31, 2004, has reiterated that replacement emission reductions that the state proposes to rely on to offset the lost reductions in ozone-producing pollutants from the proposed closure of the northern Kentucky vehicle testing program must occur in a "contemporaneous" manner, in determining that the reductions created when the Newport Steel facility closed its electric arc furnace cannot be used.

KRC had argued that the Newport Steel reductions could not be used (click on "KRC Comments On Proposal To End Northern Kentucky Vehicle Emissions Testing" to read those comments) that while the facility indicated by letter in 2004 that it had permanently shut down the furnace, the facility had not operated the furnace since April 1, 2001, so that the emission decreases in the air were not "contemporaneous" and offsetting reductions but had occurred more then three years prior to when the state planned to close the vehicle program. EPA has agreed with that position.

The state will now be required to identify other surplus, contemporaneous, enforceable reductions, and will have to amend the proposed state implementation plan submittal, before EPA will approve an end to the vehicle testing program.
