Vehicle Emissions Testing Suit Filed  Posted: November 18, 2003
On November 1, 2003, the Metro Louisville Air Pollution Control District shut down the vehicle emissions testing program for Jefferson County, Kentucky, in direct violation of its federal Clean Air Act obligation to maintain the vehicle inspection and maintenance program until the Environmental Protection Agency approved closure of the program based on a demonstration that the air quality standards for ozone would continue to be met and that air quality would not worsen with the program closure.

On behalf of Metro Louisville resident Sarah Lynn Cunningham and other KRC members in Jefferson County, KRC filed suit November 17 in U.S. District Court for the Western District of Kentucky seeking an injunction to require reinstatement of the program until such time as the local government demonstrates that it can end the program without worsening air quality.
