A new subsection (j) of KRS 13A.240(1) to read:

(j) For regulations other than those promulgated pursuant to federal mandate or pursuant to a federally delegated program, the proposed regulation shall be accompanied by a qualitative assessment, based on available information, of the range and distribution of anticipated: compliance costs to the regulated, public costs avoided, and benefits to the regulated entities and to the public from implementation of the proposed regulation.
