Supreme Court To Hear Argument On Zoning Appeal Bond Law

On February 7, 2024, at 10 a.m., the Kentucky Supreme Court will hear oral argument in the case of Bluegrass Trust For Historic Preservation v. Lexington - Fayette Urban County Government.  The case involves KRS 100.3471, a punitive and unfair law requiring that a citizen appealing a circuit court decision on a zoning matter post a significant financial bond prior to exercising an appeal of right to the court of appeals.  KRC filed a "friend of the court" (amicus) brief supporting the Bluegrass Trust and arguing that the law violates numerous provisions of Kentucky's Constitution.  To read KRC's brief, click here.
