Requirement For Animal Waste Permit To Include Nutrient Management Plan Is Upheld

In a decision issued on March 15, 2024, the Kentucky Court of Appeals upheld the revocation of an animal waste permit for a large hog feeding operation for lack of filing a nutrient management plan.  The plan was plainly required by the application form to be attached to the application but was not, and the Court held the Cabinet was justified in revoking a permit issued improvidently without such a plan having been attached.  To read the Court's unpublished opinion, click here.  Unless a motion for discretionary review is filed within 30 days or a motion for rehearing within 20, the decision becomes final.
